220 Australian Securities and Investments Commission Act

Offence:

(1)   A person must not engage in behaviour that obstructs or hinders the Panel of the Disciplinary Board, or a member of the Panel, in the performance or exercise of the board’s powers or functions; or disrupt the hearing.

 

(2)   A person must not contravene a direction under s. 216(5)(b) [directions re publication of evidence before the Panel or documents lodged].

 

Penalty:

 

(1)   3 months imprisonment.

 

(2)   30 Penalty units.

How committed:

 

(1)   A person who having received a summons to appear at the Panel, turns up hours late.

 

(2)   A witness at a Panel hearing speaks to the press about their evidence and says what it is.

Defence: ss. (2) Reasonable excuse.

 

The defendant bears the evidential onus.

 

(3)   An offence constituted by a contravention of subsection (1) or (2) is punishable on summary conviction.
